Policy, Returns & Terms of Conditions
By ordering and purchasing from The Tiffin Co. you (the customer) agree to the following terms and conditions as stated below. These are subject to change without notice. Production schedules will be established and adhered to by customer and The Tiffin Company (TTC), provided that neither shall incur any liability or penalty, or delays due to state of war, riot, civil disorder, fire, strikes, accidents, action of government or civil authority and acts of God or other caused beyond the control of customer or TTC.
CUSTOMER-FURNISHED MATERIALS - Garments, stock, camera copy, film, color separations and other customer furnished materials shall be manufactured, packaged and delivered to TTC's specifications. If you choose to provide your own garments in lieu of ordering with TTC you assume the risk of misprints. A credit will be given for the print cost only. The garment will not be replaced. Additional cost due to delays or impaired production caused by specification deficiencies shall be charged to the customer.
TERMS - Orders will print 7-10 business days after approval of art and 50% deposit. 30% Rush charge on orders needed in less then 7 days. All orders will be processed within 10 business days under the following conditions: 1) 50% deposit payment (including artwork charges if applicable), unless otherwise arranged. Buyer shall pay the balance due on the order at the time of delivery 2) Verbal approval of their artwork, 3) Merchandise is in stock. Clients who wish to waive sample approval also waive all merchandise return rights. Due to the variety of computer programs, we recommend that all customers have a sample print made for their final approval. If the customer declines a sample print, they will forfeit their right to any merchandise returns. All return must be received within 3 days after receipt of merchandise. Any returns, misprints or unclaimed merchandise which is not purchased by the customer becomes property of The Tiffin Company. The Tiffin Company has the right to use these items as they deem necessary. Due to the custom nature of our business, The Tiffin Company will not offer a cash refund on any merchandise. After we have reviewed the return merchandise and agreed that it does not meet the sample print specifications, The Tiffin Company will provide a merchandise credit.
GENERAL WARRANTY - TTC shall disclaim any and all express or implied warranties of merchandise ability or warranty of fitness for a particular purpose. Although the printer uses quality materials, due to the wide variations in laundering conditions and detergents, TTC does not guarantee against fading or shrinkage of garments during the laundering. DYE LOT - Due to the practice of batch processing knitted goods when they are dyed, printer cannot guarantee consistency of color on garments from dye lot to dye lot or from one order to the next
. SUBSTITUTIONS - TTC reserves the right to substitute material of equal or better quality without notification, unless advance notification is previously agreed to in writing.
INDEMNIFICATION - The customer shall indemnify and hold harmless TTC from any and all loss, cost, expense and damages on account to any and all manner of claims, demands, actions and proceedings that may be instituted against TTC on grounds alleging that the said printing violates any copyright or any proprietary right of any person, or that it contains any matter that is libelous or scandalous, or invades any person's right to privacy or other personal rights except to the extent that TTC has contributed to the matter. The customer agrees to, at the customer's own expense, promptly defend and continue the defense of any such claim, demand, action or proceeding that may be brought against TTC, provided that TTC shall promptly notify the customer with respect thereto, and provided further that TTC shall give to the customer such reasonable time as the urgency of the situation may permit in which to undertake and continue the defense thereof.
